1. Acceptance & Eligibility
By accessing or using WodBuddy (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
Age Requirement: You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian’s permission to use the Service. By using WodBuddy, you affirm that you meet these requirements.
2. Changes to Terms
We may modify these Terms at any time. We’ll notify you of material changes via in-app notification or email. Continued use after changes constitutes acceptance.
3. License & Scope of Use
Individual License: Subject to these Terms, we grant you a personal, non-exclusive, non-transferable license to use WodBuddy for your own personal fitness tracking and non-commercial use.
Commercial Facility License: If you represent a fitness facility, gym, or "Box," we grant you a limited commercial license to:
- Display WodBuddy content (e.g., Daily Workouts) on screens located within your physical premises.
- Promote the use of WodBuddy to your members and clients.
Restrictions: Under this commercial license, you may not:
- Charge a separate fee specifically for access to WodBuddy content (resale).
- Remove, obscure, or alter any WodBuddy logos, branding, or copyright notices displayed on the Service.
- White-label the Service or claim it as your own proprietary software.
Partnership Agreements: Specific partnership programs (e.g., bulk memberships or "Box Perks") may be subject to a separate written agreement that supersedes these Terms where applicable.
4. Accounts
You must register an account to access certain features. You’re responsible for keeping your password secure and for all activity under your account.
5. Subscriptions, Payments & Refunds
Free & Paid Services: WodBuddy offers both free and paid (“Premium”) features. We reserve the right to modify, terminate, or move features between free and paid tiers at any time without prior notice.
Billing: Subscription fees are billed in advance on a recurring basis. You authorize us (or our third-party payment processors) to charge your payment method at the start of each billing cycle.
Refund Policy: All sales are final.
- App Store / Play Store: If you subscribed via an app store, refunds are subject to that store's refund policies and must be requested directly through Apple or Google.
- Direct Payments: If you paid us directly, refunds are granted solely at our discretion and are not guaranteed, except where required by applicable law.
6. Intellectual Property & Machine Learning
Our Content: All content, trademarks, and data within WodBuddy are our property or licensed to us. You may not reproduce, distribute, or create derivative works without our prior written consent.
Your Content: You retain ownership of the data you input (e.g., workout logs). However, by using the Service, you grant WodBuddy a worldwide, perpetual, royalty-free license to use, reproduce, and modify your content to operate and improve the Service.
AI & ML Usage: You explicitly acknowledge and agree that we may use your anonymized or aggregated workout data, including inertial sensor data, to train, test, and improve our internal artificial intelligence and machine learning models. We do not share this training data with third parties. WodBuddy retains exclusive ownership of all insights, algorithms, and models derived from such data.
Workout Images & AI: We use Google Gemini to create structured workouts from images you provide. These images are used for ephemeral processing only and are not stored by us or Google, nor are they used by us or Google to train AI models.
7. User Conduct
You agree not to:
- Reverse engineer, decompile, or disassemble the Service.
- Use the Service for illegal activities.
- Interfere with the operation or security of the Service.
8. Third-Party Links & Services
The Service may link to third-party websites or services. We’re not responsible for their content or practices. Your use of third-party services is at your own risk.
9. Termination
We may suspend or terminate your access for violation of these Terms or inactivity. Upon termination, your right to use the Service ends, but obligations and liabilities incurred prior survive.
10. Modifications to the Service
WodBuddy is an evolving product. We reserve the right to modify, suspend, or discontinue any part of the Service (including specific features, workouts, or data history) at any time, with or without notice. We are not liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
11. Disclaimers
The Service is provided “as is.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, our liability is limited to the amount you paid in the past 12 months. We’re not liable for indirect, incidental, or consequential damages.
13. Force Majeure
We generally will not be liable for any failure or delay in performance of the Service due to causes beyond our reasonable control, including but not limited to: acts of God, war, strikes or labor disputes, embargoes, government orders, or any other force majeure event.
14. Governing Law
These Terms are governed by the laws of Brazil, without regard to conflict of law principles. Any dispute will be resolved in the courts of São Paulo, SP.
